
Federal Confidentiality
Confidentiality is the cornerstone of any kind of helping relationship.
Quite simply, what this means is that without your explicit permission
we will not tell anyone or any organization anything about you; in fact,
we will neither confirm nor deny that you were even at the program.
There are, however, circumstances under which we will provide your
records to others. They are as follows.
- With your written consent.
- After a hearing in which a court orders us to do so.
- A disclosure can be made to medical personnel in a medical
emergency or to qualified personnel for research audit or
program evaluation purposes.
Violation of the Federal law and regulations by a program is a crime.
Suspected violations may be reported to appropriate authorities in accordance
with Federal regulations.
Federal laws and regulations do not protect any information about a
crime committed by a patient either at the program or against any person
who works for the program or about any threat to commit such a crime.
Federal laws and regulations do not protect any information about suspected
child abuse or neglect from being reported under State law appropriate
State or local authorities.
We will ask you to execute (sign) a consent document before the program
begins. It uses language provided by the state and spells out the kinds
of information that will be provided to the court that sent you here
and the state agency which is responsible for Driver Intervention Programs.
Copies of the Federal laws governing confidentiality of your records
are available at your request to the director. Our release-of-information
forms are available as well.
Because confidentiality is so important to us, we want you to be very
clear about it. While my staff and those associated with the program
take this issue very seriously, we cannot assume any responsibility
for a breach of confidentiality caused by actions of individuals not
associated with the program or by other program participants. There
may be times during the course of the program when we are in a public
area, therefore, we cannot guarantee you will not be seen by others
while engaged in the program.
Advances in technology including cell phones with camera and video
features present significant challenges to our efforts to protect the
confidentiality of individuals participating in the program. All individuals
will be required to sign an agreement that states the use of such devices
or permitting another to engage in the use of such devices while participating
in the program is strictly prohibited. Any violation of this agreement
will result in dismissal from the program and notification of the appropriate
state authorities. Once again, however, we cannot guarantee that all
individuals in the program will respect each other in the manner that
is expected and appropriate.
